I having to start a new thread as the reply button has gone off my screen.
Well you can knock me down with a fuffy duster.
 So here goes.
When I said that a person who has no insurance is not worth persuing, it was in general type of reply.
That up to the person who has  suffer losts. to try and find out. if the other person has any money or belonging worth sueing for.
So, you take him to small claim and win you case, so what them.
If the other person does not turn up you will have won you case, you will be granted judgement in default.
You will have had to pay a fee to the court to enter the summons. You will have maybe lost wages from your job or had a day leave from your hoildays. or whatever.
So if the other person don,t pay you what you going to do.
The next stage is either apply to the court for court balliffs to try and get you your money or seek a attachment of earning order.
Yes you are all right, more pay out of fees to the court.
So if the balliffs report back to the court, he got nothing worth the money we need to recover, that the end of that.
But wait, you might be in with a shout.
Find out if he got a regular job.
If so find out his employer and the address.
See, this is where it is differcult. you got to find all this information out yourself to give to the court.
If you can get his employers address, you half way there.
Apply to the court for the attachment of earning order to be made.
Yes you got it now you learning fast yet more pay out of your pocket.
Of course all this costs will be charged to the other person.
Look all this is taking up my valued time, I mean there are people wanting my attention on other matters like small wheels versue large wheels. but I will just state this.
I had two cases of renting a small house to two different people. (It was my wifes house that has now been sold).
So Ist case. paid a few weeks and them stopped. Took him to court. he did not show up so I was granted judgement in default.
Still did not pay up.
So all his stuff was on finance so no goods to process.
This was easy for me because he had to fill in letting forms so his employer name and address was on these.
So attachment of earning order was granted.
So still no pay up.
So next stage. Manager Director of firm ordered to appear before Court on a certain day and time to say why not.
Did not get that far, suddenly money was being paid into court. The defendant is not allowed to pay you it has to go into Court and the court send it to you at the end of each month.
They will only accept cash or chegue supported by bankers card.
So I got my money and all my costs and interest over a few months. but like I just said it took some time.
Case 2.
The same but I only got a quarter of what I was due as the person got the sack for mis-conduct so then did not have a job and cleared off to Bristol somewhere. So that was the end of that.
I was not going to spend more money in employing private tec's to try and find him.

That about I am wrong again on the last thread.
There are some people who think they know and some people who do not know.
I know what I know, but does that rude person know what he don't Know?
All that about the CPS. they are only involved in certain cases, certainly not in a car door being damaged, even if it was caused by a drunk.
This is what happens.
A police officer sees a boy stealing apples from someone tree in their garden.
He can do one of three things. Go back to sleep if he sitting in his Police car in a layby or side street.
Tell the boy off and let him go or take him back to the Police Station to be dealt with.
It then for the Senior Police Officer to say yes or nay. as to continue on with action. Not the CPS.
Then the parents have to be called in and statements made.
But its like that for all minor cases not involving the CPS.
The CPS was not involved when my case went into court when five boys jumped over my car causing lots of damage costing more than a couple of hundred pounds.  
Nor was the CPS involved when some boys playing truant from school tried to set light to a block of garages belonging to some flats.
I been in my time to a number of cases in courts as witness etc and I don't remember once having the CPS involved at any stage.
At the end of all cases I have been in court of, towards the end, the magistrate has looked up and said, is there any application to be made for costs. that when the police officer should say. "Yes sir, the plantiff has had loss of this that or the other and so on".
A judgement will then be granted to the plantiff against the defendant.
But the court will not proceed to recover your money its up to you to go about that.
There is not more I can say. Some will find this helpful and some will think they know different.
One last point. look in you evening newspaper, I will say the plantiff was granted costs of such and such an amount.

Just to say my bit, and simon will laugh at this.
 
When i were a boy i was driving my Mk1 granada 3.0 Ghia to buy my insurance at the comapany I used only 1 mile away, and drove into the back of a shiny new Rover 216, brand new d reg, totally wrecked, broken, and me with my £500 in mee pocket for insurance, oh dear.
I ended up buying the rover, sorry paying for it to be repaired, and paying the cost off weekly, because i had no insurane, cost me over £5500, alot of cash when you are 18 yrs old.
I did pay every penny back though, but how unlucky is that.
 
Then i got stopped by boys in blue about 6 months later for MS50, that was the code, and it was motor racing on the public highway, admitted it as i was, went to court, having paid out my £500 for my insurance after the crash, and gotdone for motor racing , £400 fineand a 12 month ban but then i got done for no insurance as your insurance doesnt cover you for racing and time trials, 8 points andanother £250 fine. Ehh i laughed all the ay home,and had to sell the car to pay the fines.
The bloke who went into court before  was 2 times over the limit, crashed his car trying to get away from the police and got a 12 month ban and £100 fine, wheres the justice eh, i ask you, but im not bitter though, no, no I think the police do a stearling job,  Lips Sealed Lips Sealed Lips Sealed
