Hi Guys and Girls.
Has anyone suffered in the way I have,
A Drunk Driver trying to turn around outside my home, Pushed in my nearside rear door, I rushed downstairs and confronted this a-hole, I could seen in his face he was drunk so I called the boys in blue.
They arrived and took all the details down, and I was taken to the local police station to give a statment. I was assured by the boys in blue, they had given me all the relavant info for me to make a claim against this
a-hole.
I contacted my insurer and my car was repaired, at a cost of £220.00 to myself for my insurance excess.
I waited some time to hear from my insurer that they had recoverd the cost of repair plus my excess,
on phoning I was referred to a solicitor to recover my losses, time went on so I contacted this solicitor to be told that they had written to the third party, but had not had a reply and that they would only write two letters without reply, the case would be closed.
I contacted the police again to try to gain some info about this a-holes court case, To be told by a sargent that the third party had no driving licence no insurance and the car did not belong to him.
The police also informed me that at this a-holes court case, he was banned and fined for drink-driving and not having a valid licence, But to my dismay nothing about having no insurance, The police told me that drink-driving was a more important charge than not having insurance so they did not prosecute him for that, And that if I wanted to, I could recover my losses through small claims court.  
I was dumfounded by this remark from the police. I feel thats very poor, After nine years driving professionally and pleasure I had full no claims bonus, Because of this a-hole I have lost my £220.00 excess payment and had made a claim, my premium went up by a further £ 50.00.
I do not have the money to chase this a-hole through the courts.
Is this a further reminder of how society has gone down to the dogs.

Unfortunatly seeing as he had no licence or insurance the small claims is the only way. See if you can find out where he lives then beat the  poo poo out  of him >:( >:( >:(

He has probably fitted 10" wheels by mistake so it will take him a little longer to get here,lol, ::).

I agree with BBT. Find out where he lives and go round and beat him senseless. Simple justice.

You wont get any justice otherwise in this country, the cops are scared of breaching the criminals human rights and in any case are too concerend with their pensions to worry about the rest of us!!

I sorry I have been away, but I been so busy dealing with small wheels versu large wheels. It real hard trying to convince some people that small will go round more times than large over the same distance.
But sorry about you loss on your car door.
And again sorry but you have had it.

No point in sueing in the small claims. if he can't afford the money for insurance he got no money or effects to pay you. The court don't pay you' its him that will have to do so.
That's why I never pay any extra for legal aid. its a rip off, when you want help, they find an excuse for not helping you.
You can't claim off the car owner, only the driver. well in this case.
Never trust a policeman.
In court the police could and should have pointed out that you suffered losses of whatever they where, The court would them order the person to pay to you this amount.
At the end of the case, the court alway ask the police is there any costs or losses that you need us to consider. That's when they should have put forward your losses.
Sorry its worked out like that.
Its only like talking about insurance issues like this that people know what to do next time but some like to bury their heads in the sand.

I seem to remember a scheme that compensates drivers hit by the uninsured and normally the Police will hand you a leaflet with all the details for claiming compensation from the government fund. I'll search about and see if I can find any reference to it.

Pede, Sorry to hear about your problem, it may be worth contacting the police and/or the court to see how the fine was paid, if it was paid in ful or in large instalments then the other party obviously has some funds and will be worth pursuing, they shouldn`t tell you anything but can be very helpful if the ituation is explained.
Johnv, you make some bizzare claims. How do you know that the uninsured driver had no money ? Many people choose to avoid paying their way whether they can afford it or not, a neighbour of mine was recently prosecuted for driving uninsured in his 4 year old ( fully paid for ) Maserati.

Isn`t this a bit extreme ? Whilst we have all com across some idiots in blue the majority are honest & reliable. It is true that some of the systems they have to run are ridiculous but you cannot blame those on the front line for decisions made higher up. Wrong I`m afraid, the prosecution of the case would be carried out by the Crown Prosecution Service, they decide what to prosecute, what evidence to present and what to mention to the court.

if the case went thru the courts via CPS  i thought that they paid out to the person claiming and then they claimed it back from the "criminal" including their costs. i dont know for sure tho............ just my take on it :-/. OH and Jonv, my father was a copper for 30 years with an exemplary record. Worked his way up the ranks  and  retired at 50. There are very very few bad apples  and as Paul stated most are honest and reliable......  I too hope you dont have to call on them in a crisis as that would seem a little hypocritical of you......

i was once told by a police officer that you can do anythink you like as long as there are no witnesses. I mean what a thing to say.
I have  got a brother who used to be a Police Officer, retired now. so i do feel able to speak about what really goes on.
In Coventry and Nuneaton, people in the early hours have been slashing peoples tyres. like 60 to 80 cars in one go. and it still going on.
Because nothing is being done about it it now spread into other places like Birmingham.
There are lots of police officers that when on nights in fact collect their cars and then head home to watch the TV.
Also on the other side of the road there was The Chief Police Officer of the city where I live. He retired now but I was on good terms with him, he has told me about how he would have loved to have sacked so many PC'S but the onus of proving it is so great he could only watch like a hawk, ready to take action where he could.
I know quite a lot of top brass in Coventry and Birmingham. Its a good job they don't share some people views on their own Police Officers that they command.
